ChitChat Terms and Conditions & Privacy Policy

Welcome to ChitChat (chitchat-online.com)!
This document serves as both our Terms and Conditions ("Terms") and our
Privacy Policy. It governs your use of the ChitChat service ("Service"),
a personal project designed for online conversation. By creating an
account and using our Service, you agree to these terms in their
entirety.
1. Acceptance of Terms
To use ChitChat, you must explicitly agree to these Terms. You indicate
your agreement and provide your consent by checking the box labeled "I
have read and agree to the Terms and Conditions & Privacy Policy" during
the account creation process and/or upon logging in after these terms
have been updated.
Simply using the website without this explicit confirmation does not
constitute an agreement. If you do not agree to these terms, you must
not create an account or use the Service.
2. User Conduct
You are responsible for your conduct and any content you post, share, or
upload on ChitChat. You agree not to post content that is illegal,
harmful, threatening, abusive, defamatory, or otherwise objectionable,
as determined by the ChitChat administration.
3. Content Moderation & Our Right to Intervene
Our primary goal is to maintain a functional and safe community.
However, as the operator of this private Service, we reserve the right
to moderate content to prevent harm and address violations of our rules.
The responsibility for the platform's environment ultimately rests on
the administration.

Our Philosophy: We do not proactively or constantly
monitor all private conversations (Direct Messages or "DMs"). We
respect user privacy and will not access your private messages for
casual browsing or "for fun."

Initiation of Review: Our intervention is reactive,
not proactive. We will only investigate or search for specific
messages after we receive a report or become aware of a
potential problem. Reports may come from other users or third parties.
There is no automated "flagging" system for DMs; reviews are initiated
by human reports.

The Review Process: When a report is received, an
Administrator may use search tools to locate the problematic content.
These tools allow searches based on various parameters, including:
- Keywords or specific content
- Date range
- Specific users
- User role or subscription status (e.g., Pro users)

Decision-Making Criteria: All decisions regarding
content violation and subsequent actions (such as message deletion or
account suspension) are made at the sole discretion of the lead
administrator.
You explicitly acknowledge that this review process is subjective
and based on the administrator's personal judgment and opinion of
what is acceptable on the Service.
There is inherent bias in this system, and by using ChitChat, you
accept this method of moderation.

Collaboration: In some cases, the lead administrator
may consult with other hand-selected administrators in a private chat
to discuss a situation before taking action.
4. Privacy Policy
Your privacy is important, but it is not absolute on this platform. This
section explains how we handle your data and private communications.

Data We Collect: We collect information necessary for
the Service to function, such as your username, login credentials, and
the content you generate (messages, files, etc.).

Access to Private Messages: As stated in Section 3,
we will not access your private messages unless a credible report of a
rules violation has been made. The only content reviewed will be the
content relevant to the report. We do not engage in widespread
surveillance of user DMs.

Data Sharing: We will not share your personal data or
messages with third parties, with one critical exception: if we are
compelled to do so by law enforcement or a valid legal order. If
activity on the Service involves illegal acts that could bring legal
liability to the platform or its owner, we reserve the right to
cooperate with the authorities.

Service Integrity: We do not possess, and will not
implement, the technical ability to tamper with or modify the
functionality of direct messages between users, such as preventing two
users from conversing or fabricating conversations.
5. Administrator and Moderator Roles

Administrators ("Admins"): A small, hand-selected
team with access to the administrative tools necessary to search for
and delete content across the platform, as described in Section 3.
This access is reserved for handling serious issues, especially when
the lead administrator is unavailable.

Moderators ("Mods"): Moderators have limited
permissions. They can only delete messages within the public chats or
rooms they are a part of. They do not have access to your private DMs
or the administrative search tools.
6. Limitation of Liability
ChitChat is an unofficial, personal project provided on an "as-is"
basis. We make no warranties regarding the reliability, security, or
availability of the Service. We are not liable for any data loss,
damages, or other issues that may arise from your use of our Service.
7. Changes to These Terms
We may update these Terms from time to time. When we do, we will make a
reasonable effort to notify you. This notification may take the form of:
- A message displayed upon your next login.

A notification message in a designated public chat (e.g., a "rules" or
"announcements" chat).
Your continued use of the Service after such a notification constitutes
your acceptance of the revised terms. It is your responsibility to
review the terms periodically.
8. Termination
We reserve the right to suspend or terminate your account at any time,
for any reason, without notice, particularly if you violate these Terms.
